Each commission is individually created based on the companion, client preferences, creative direction, and selected artwork options.

3. Portrait Commission Services

Rolling Pawtraits provides custom portrait experiences rather than standardized products.

The commission process may include:

  • Initial inquiry and consultation

  • Creative planning

  • Photography session

  • Artwork selection

  • Artistic production

  • Delivery of final artwork and/or digital files

Submitting an inquiry does not guarantee acceptance of a commission or create a binding agreement.

A commission is confirmed only after the project details, payment arrangements, and other applicable terms have been agreed upon.

Rolling Pawtraits primarily provides in-person portrait services within Southern California. Requests outside our standard service area may be considered on a case-by-case basis and may require separate travel arrangements.

4. Booking, Deposits, and Payment

A deposit may be required to reserve a commission date.

Deposit amounts, payment schedules, cancellation terms, and other financial arrangements will be communicated and agreed upon before booking.

Payment obligations and booking conditions may vary depending on the scope of the selected commission.

An inquiry or consultation does not create an obligation for either party to proceed with a commission.

Rolling Pawtraits reserves the right to begin services only after required payments and booking requirements have been satisfied.

5. Client Responsibilities

To help create a successful portrait experience, clients agree to:

  • Provide accurate and complete information regarding their companion and commission request

  • Communicate respectfully and professionally throughout the process

  • Provide appropriate access and conditions for scheduled sessions

  • Ensure that their home or chosen session environment is reasonably suitable for a portrait session

  • Ensure that any materials, images, or information provided to Rolling Pawtraits may be used for the purposes of creating the commissioned artwork

Clients represent that they have the necessary rights or permissions to provide any reference materials submitted to Rolling Pawtraits.

Rolling Pawtraits does not assume responsibility for verifying ownership of client-provided materials.

Clients are responsible for ensuring that any reference materials provided to Rolling Pawtraits do not violate the rights of any third party.

6. Companion Safety and Session Conditions

Because portrait sessions may take place in private homes or other personal environments, client cooperation and safety are essential.

Clients are responsible for providing a safe environment and appropriate supervision of their companions during the portrait session.

If a companion displays aggressive, dangerous, or unsafe behavior that creates a risk of injury to people, animals, or property, Rolling Pawtraits reserves the right to pause, modify, reschedule, or end the session.

Rolling Pawtraits may determine, in its reasonable discretion, whether conditions are suitable to continue a session.

Clients remain responsible for any damages, injuries, or losses arising from their companion’s behavior.

7. Artistic Interpretation and Creative Process

Rolling Pawtraits creates original artwork through a personalized artistic process.

Each portrait is a unique artistic interpretation based on provided reference materials, creative direction, and the individual characteristics of each companion.

While we strive to create artwork that reflects your vision and captures the personality of your companion, final results may vary from reference images or expectations due to artistic decisions, creative interpretation, environmental factors, and other elements of the creative process.

Rolling Pawtraits does not provide photographic reproduction services or guarantee an exact replica of any reference image.

8. Reference Materials and Client-Provided Content

Clients may provide photographs, images, or other reference materials to assist with the creation of their commissioned artwork.

Clients represent and warrant that they have the necessary rights or permissions to provide these materials.

Clients are responsible for ensuring that any reference materials provided to Rolling Pawtraits do not violate the rights of any third party.

Rolling Pawtraits uses client-provided materials only for purposes related to creating, managing, and delivering the commissioned artwork, unless otherwise agreed in writing.

9. Artwork Delivery, Digital Files, and Archive

Depending on the selected commission package, clients may receive final digital image files and/or physical artwork products as described in their individual commission agreement.

Unless specifically agreed in writing, raw photographs, original camera files, unedited source materials, and working files are not included.

Final delivered files represent the completed commissioned work and may differ from internal working files or production materials.

Rolling Pawtraits may retain selected project files, final artwork files, and related materials for archival, service, quality assurance, or internal business purposes.

However, Rolling Pawtraits does not guarantee indefinite storage or continued availability of all original files.

10. Intellectual Property Rights

All original artwork, creative concepts, designs, website content, photographs, and related materials created by Rolling Pawtraits remain the intellectual property of Rolling Pawtraits unless otherwise agreed in writing.

Purchase of artwork or receipt of digital files does not transfer copyright ownership unless expressly agreed in writing.

Clients receive personal, non-commercial rights to enjoy and display purchased artwork.

Personal use may include:

  • Displaying artwork in a home or personal space

  • Sharing artwork on personal social media accounts

  • Creating personal prints for private use

Commercial use, licensing, resale, merchandise production, advertising use, publication, or third-party use requires prior written permission from Rolling Pawtraits.

11. Portfolio and Promotional Use

Rolling Pawtraits values client privacy and respects each client’s preferences regarding public sharing.

Client images, companion images, commissioned artwork, or related materials will only be used publicly for portfolio, website, social media, or promotional purposes with appropriate client permission.

Even when public sharing permission is not granted, Rolling Pawtraits may retain private internal records for archival, quality assurance, and service-related purposes.

12. Website Content and Digital Materials

All content on the Rolling Pawtraits website, including photographs, artwork, text, designs, branding elements, and other materials, is owned by or licensed to Rolling Pawtraits and is protected by applicable intellectual property laws.

Rolling Pawtraits may also decline or discontinue services when reasonably necessary due to circumstances affecting our ability to provide services.

15. Disclaimer of Results

Rolling Pawtraits provides personalized creative services.

While we make every effort to create artwork that reflects each client’s vision, we do not guarantee that final artwork will exactly replicate reference images, website examples, or a specific expected outcome.

Each commissioned portrait is unique and influenced by artistic interpretation, creative direction, and individual circumstances.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Rolling Pawtraits shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the use of our website, services, artwork, or related materials.

In any circumstance where liability cannot be excluded, Rolling Pawtraits’ total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Clients agree to indemnify and hold harmless Rolling Pawtraits, its owners, contractors, and representatives from claims, damages, liabilities, or expenses arising from:

  • Client-provided materials

  • Client actions or omissions

  • Companion behavior

  • Violation of these Terms

  • Violation of third-party rights

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
